BackgroundI am a Consultant Orthopaedic Surgeon in the Cardiff and Vale NHS. As a consultant, I have an active trauma commitment, which includes treating patients with the type of problems included in personal injury reports. I have received formal training in report writing and courtroom skills. I have obtained the EXPERT WITNESS CERTIFICATE, which is a diploma from Cardiff University organised by Bond Solon (CUBS certificate). PublicationsI have numerous trauma and orthopaedic related publications. All these are published in peer review journals and many have been presented at International Trauma meetings. Medico-legal experience Report writing experience: 10 years Claimant/Defendant/SJE ratio: 60:20:20 approx Number of reports per year: 400 approx Average time from instruction to consultation: 4 weeks Average time from consultation to report dispatch: 7 days Medico-legal feesAverage report: £350 (same for joint instruction) Complex reports: Depending on time spent in preparation. Always discussed with Solicitors/agencies concerned.
Court AttendanceA charge of £1,000 for each day or part of the day reserved for court attendance will be charged if less than 2 working days notice of cancellation is received, £500 if less than 15 days notice and £150 if less than 6 weeks. Settlement of accountsSettlement of my fees should be within 90 days of receiving the report. In non-Legal Aid cases, Solicitors will be personally responsible for my fees. In Legal-Aid cases, Solicitors are required to obtain prior authority of the Legal Aid board for payment of my charges, and the Solicitors are to promptly apply to the Legal Aid Board for an interim payment to meet my charges. * If medical notes and X-rays are provided with the client at the time of consultation and take less than 15 minutes to review, then there will be no supplementary charge. |
